The Decision and Discretion of Capella Hospitality International in regard to the eligibility of any purchaser for being considered for the Vacations Ownership shall be absolute and the beyond contest.

The vacation owners can exchange their entitled week with Capella Hospitality International vacations current associate’s resorts of the year in which member’s wishes to take vacation without any exchange fees. Apart current associate’s resort member can utilized different hotels and resorts by paying exchange fee. Currently Domestic Exchange Fees is $ 199 to $ 249 and International & $ 299 to $ 349.
Capella Hospitality International provides an option to instantly covert the payment towards product price into EMI options at applicable rates for selected banks as per terms and conditions of the bank. The charges applicable on EMI depends of various banks policy.The Vacations Ownership fee/amount mentioned should be paid via cheque/DD/PO/Credit Card/Debit Card favouring CAPELLA HOSPITALITY INTERNATIONAL Cash remittance if any should be made only to Capella Hospitality International office accounts department and spot receipt should be obtained. Company is not responsible for cash payment made or alleged to be made to company sales person or anyone.
Availability of Resort & booking is subject to change from time to time and can be confirmed on the basis of real-time online availability.
No request for transfer of confirmation shall be entertained by Capella Hospitality International.
we understand the terms and conditions of the special enrolment offer/s that I/we have chosen at the time of booking up for the Capella Hospitality International package. I/we understand that any payment made by me/us would be appropriative toward the purchase fee and balance if any would be payable towards the entitlement.
we understand that in the event of request for cancellation of Vacations Ownership after the registration period Capella Hospitality International shall not be liable to refund any amount paid to us after cool off period of 7 days as per government policy.
we understand that any part payment made by me/us towards an outstanding shall first be appropriated towards interest and then earlier dues/outstanding. I/we confirm that there are no verbal or written promises or any other assurances not mentioned in Vacations rules that have been by the personal of Capella Hospitality International.
Vacations Ownership means specific days of stay opted by you at any resorts offered by Capella Hospitality International.
Day means time interval between the check in, time of a specified calendar date and checkout time of the subsequent calendar as prevalent in the particular resort or hotel.
The Purchaser agrees to indemnify and keep indemnified Capella Hospitality International against any loss, damage, claims, costs and expenses which may be incurred or suffered by Capella Hospitality International International in respect of the availability of Vacation under this Offer.
If you suffer injury, illness or death directly as a result of the services provided as part of your holiday we are not liable to make any payment to you. We will not make any payment if your injury, illness or death was caused by an event or circumstances which the person who caused it could not have predicted or avoided even if they had taken all necessary and due care. We will not make any payment if your illness, injury or death was your own fault.
You should cooperate fully with us if we or our insurers want to enforce those rights.
If you or someone on your holiday booking is injured, falls ill or dies while taking part in an activity which is not part of the vacations, or you need to incur unpredictable extra expenses for which we are not liable because the event is beyond our control we will, where appropriate and subject to our discretion, try to help if we can.
You must make a claim under your insurance policy’s legal expenses or other appropriate section.
We reserve the right to refuse to accept you as a customer or continue dealing with you if we, or another person in authority, believe your behavior is disruptive, causes unnecessary inconvenience, is threatening or abusive, you damage property, you upset, annoy, disturb, or put any other traveler or our staff or agents in the resort in any risk or danger, on the telephone, in writing or in person.
If our resort staff or agents believe that you could be disruptive or that you are suffering from a contagious disease, they can also refuse to let you proceed with your travel arrangements, restrict your movements on board, or remove you from your accommodation or excursion.
If you are evacuated for your misbehavior, we will treat your booking as cancelled by you from that moment, and you will have to pay full cancellation charges. If this occurs overseas then you will become responsible for your own return home and any other members of your group who cannot or will not travel without you. We will not be liable for any refund, or compensation or any costs or expenses you incur.
If you are refused accommodation because of your behavior, or you are under the influence of alcohol or drugs, the resort may pass on your details and date of the refusal to other resorts for their information. This in turn may make it difficult for you to book other resorts. In any of these circumstances no refunds or compensation will be paid to you and we may make a claim against you for any damages, costs and expenses (including legal expenses) incurred as a result of your behavior including but not limited to (i) repairing or replacing property lost, damage or destroyed by you, (ii) compensating any person affected by your actions and (iii) Criminal proceedings may also be instigated.
For the purposes of this section reference to you or your includes any other person in your group.
Capella Hospitality International is engaged in the business of Vacations Ownership We request all the customers to review travel warnings, announcements, advisories and prohibitions issued by the relevant authorities and governments prior to confirming their international bookings with Capella Hospitality International. By offering travel products for particular destinations, Capella Hospitality International International does not warrant that travel to such areas is advisable or without risk. Capella Hospitality International is not liable for damages or losses that may result from travel to such destinations.All the customers are strongly recommended to check and verify their booking thoroughly once they receive the e-mail confirmation from Capella Hospitality International. Please contact our travel experts if there is any incorrect or incomplete information, which needs to be altered or changed. In case of any changes or amendments, certain elements of the vacations package are non-refundable. It’s a fee, not a deposit. Capella Hospitality International cannot be held responsible if inaccuracies are not notified by the passenger within 1 day of sending out the booking confirmation.

By confirming your booking, you are accepting on behalf of all persons travelling on this booking that the terms of this Agreement, which incorporate the information, restrictions and obligations and the conditions of any terms and conditions constitute the entire agreement between us with regard to your booking. You also consent to our processing personal information about you and other members of your party. Where the context permits, reference to “you” and “your” will include you and all persons travelling on this booking. Your contract with us shall be governed by and construed in accordance with the law of India. You agree to submit to the exclusive jurisdiction of the courts of DELHI (India) over any claim or matter arising under or in connection with your contract with us.
In event of any dispute/claims or differences arising out of the Vacations Ownership, the customer shall contact Capella Hospitality International customer service cell for mutual discussion and resolution.
It is a condition of booking that you and all members of your party provide certain information that may be sent to governmental authorities and border control and security agencies for the purpose of security and counter terrorism. This is known as Passenger Name Records data and/or Advanced Passenger Information. The information you must provide will include, but not be limited to, full name - as shown in your passport or travel document, gender, date of birth, travel document type, number, country of issue and expiry date, your country of residence and the address for your stay.
If you are a foreign traveler, it is your responsibility to comply with all passport, visa and other immigration requirements. Your passport and travel documents must be intact; you may be refused travel if they are damaged or have been tampered with. We do not accept any responsibility if you cannot travel because you have not complied with these requirements.
In Case the purchaser(s)find any defect with the agreement the purchaser can rescind/cancel the agreement within seven days of signing the agreement by giving written notice to the company by registered post at its Corporate Offices: Nehru Place, New Delhi - 110019. In the event of purchaser giving the notice with in seven days the deposit money will be refunded after deduction on following scale :(1) 1-7 40% days (2) 8-16 days 60% (3) 16-21 days 75% (4) after 21 days 100%. of paid amount after 30 days from the receipt of cancellation request/letters. If no information is received within seven days of signing the agreement it will be presumed that the terms & conditions of the agreement are acceptable to the purchaser and that if the purchaser rescinds the contract then all the money deposited by the purchaser will be forfeited and no amount will be refunded to the purchaser.
